Special Town Meeting Warrants - August 27, 2007
TOWN OF SAUGUS


Essex, ss.
To the Constable of the Town of Saugus
Greetings:

In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of the Town of Saugus, qualified to vote in Town affairs for the Special Town Meeting at the Saugus Town Hall located at 298 Central Street on August 27, 2007 at 7:30 PM to hear and act on the following articles: viz;

Article 1.   To hear and act on reports of Committees.

Article 2.  To see if the Town will vote to accept the following:

I.      Compliance With Administrative Consent Order

1.      In order to comply with an Administrative Consent Order issued by the Massachusetts Department of Environmental Protection on April 15, 2005, the Town of Saugus must correct deficiencies in its sanitary sewer system.  In order to avoid fines levied by the Massachusetts Department of Environmental Protection, the Town of Saugus is required to ensure that no unauthorized connections and private inflow sources to the sanitary sewer system exist, such as roof downspouts, exterior foundation drains, areaway drains, sump pumps, or other sources of surface water or groundwater, as prohibited by Article III.  Section 8 of the Town of Saugus Sewer Use Regulations (the “Prohibited Uses”).

2.      All Prohibited Uses in the Town of Saugus must cease on a timeline approved by the Department of Environmental Protection over a ten-year period.  The Town of Saugus will notify every property owner with a Prohibited Use on its property 90 days prior to the time when the Prohibited Use must cease.

3.      All entities seeking to discharge new flow to the sanitary sewer system must adhere to the Inflow and Infiltration Reduction Program Sewer Connection and Extension Policy, established pursuant to the Administrative Consent Order.

4.      This by-law will expire at the time when the Town of Saugus’s commitments pursuant to the Administrative Consent Order are completed.

II.     Penalties

1.      Any person violating any provision of these by-laws shall be fined in the amount of $50 per violation.  Each day that a violation continues shall be considered a new violation.

2.      Any person violating any provision of these by-laws shall become liable to the Town of Saugus for any expense, loss, and/or damage occasioned the Town of Saugus by reason of such violation.

III.   Validity

1.      All prior by-laws or parts of prior by-laws in conflict herewith are hereby repealed.

2.      The invalidity of any section, clause, sentence, or provision of this by-law shall not affect the validity of any other part of this by-law which can be given effect without such invalid part or parts.  (Board of Selectmen)

Article 3.  To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money to supplement certain appropriations made under Article 2 of the 2007 Annual Town Meeting.  (Town Manager)

Greetings:

In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of the Town of Saugus, qualified to vote in Town affairs for the Special Town Meeting at the Saugus Town Hall located at 298 Central Street on August 27, 2007 at 7:30 PM to hear and act on the following articles: viz;

Article 1.   To hear and act on reports of Committees.

Article 2.  To see if the Town will vote to amend the Zoning By Laws by:

1.)     Adding a new definition to the Article III “Definitions” for “Solid Waste.”
2.)     Adding a new Principal Use 9 to the Table of Use and Parking Regulations in the Wholesale Transportation and Industrial Category.
And
3.) Adding a new Section 12.5 D.

The new definition “Solid Waste” shall be inserted between the definition of “Sign” and “Street” and be as follows.

Solid Waste: “any garbage, refuse, sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility and other discarded material resulting from industrial, commercial, mining, and agricultural operations, and from community or household activities including any materials destined for recycling.”

The new Principal Use  “9” in the Wholesale Transportation and Industrial Category shall come after Section 8 “Railroad Yards, Motor Freight Terminals” and shall be as follows:

9. Refuse / Solid Waste Trucking without storage or processing of refuse, solid waste hauling, storage of solid waste containers or dumpsters, recycling machinery, containers and sorting or separating of recyclables.  (See Sec. 12.5 D)  The District chart will indicate this use will be allowed in the Industrial Districts I-1 and I-2 with an S-2 permit. The parking code will be “F.”

The new section 12.5 D shall come after 12.5 C “Adult Uses” and shall be as follows:

12.5 D Refuse / Solid Waste (see def.) the following conditions shall apply:

1.)     Refuse/Solid Waste Trucking may not be located:
a.      Within 1000 feet of each other
b.      Within 500 feet of the nearest lot line of a Residential District
c.      Within 500 feet of a public park
d.      Within 500 feet of a school
e.      All trucks and containers must be stored in an enclosed roofed structure.

2.)     Signage must meet all requirements of ART. VII of this by-law.

3.)     The application for the S-2 Permit shall include the following information:
a.      Names and address of the legal owners of the business.
b.      Identification of all current clients and the nature of the refuse or solid waste that is being hauled.
c.       Identification of all facilities receiving refuse or solid waste from the applicant.
