The Board of Selectmen of the Town of Saugus, acting by virtue of the power given to it by Section 22, Chapter 40 of the General Laws of Massachusetts and by virtue of any other power it hereto enabling, hereby adopts and makes the rules and orders for the regulation of carriages and vehicles used in the said town for regulating traffic upon the streets and highways of said town which are hereto annexed, the same to be known as Traffic Rules and Orders of the Town of Saugus; insofar as the said rules and orders or any of them are the same as the regulations, rules and orders now in force they shall be deemed to be continuation thereof.

ARTICLE I

DEFINITIONS

For the purpose of these rules and orders, the words and phrases used herein shall have the following meanings except in those instances where the contents clearly indicates a different meaning.

        (1)     "BUS STOP" An area in the roadway set aside for the boarding of and the alighting from and the parking of buses.

        (2)     "CROSSWALK" That portion of a roadway ordinarily included within the prolongation or continuation of curb lines and property lines at intersections or at any portion of a roadway clearly indicated for pedestrian crossing by lines on the road surface or by any other markings or signs.

        (3)     "EMERGENCY VEHICLE" Vehicles of the Fire Department (Fire Patrol), Police Vehicles, ambulances and emergency vehicles of federal, state and municipal departments or public services corporations when the latter are responding to an emergency in relation to public safety.

        (4)     "FUNERAL" Any procession of mourners properly identified as such, accompanying the remains of a human body.

        (5)     "LANE" A longitudinal division of a roadway into a strip of sufficient width to accommodate the passage of a single line of vehicles.

        (6)     "OFFICER" Any police officer of the Town of placeCitySaugus or any officer authorized to direct or regulate traffic or to make arrests for the violation of traffic regulations.
        (7)     "OFFICIAL CURB MARKING" That portion of a curbing, the painting of which has been authorized by the Board of Selectmen and which has the written approval of the Department of Public Works of the placePlaceTypeCommonwealth of PlaceNameMassachusetts.

        (8)     "OFFICIAL STREET MARKING" Any painted line, legend, marking or marker of any description painted or placed upon any way which purports to direct or regulate traffic and which has been authorized by the Board of Selectmen and which has the written approval of the Department of Public Works of the Commonwealth of Massachusetts.

        (9)     "OFFICIAL TRAFFIC SIGNALS" All signals conforming to the standards as prescribed by the Department of Public Works of the Commonwealth of Massachusetts, not inconsistent with these rules and orders placed or erected by authority of a public body or official having jurisdiction, for the purpose of directing or warning traffic.

        (10)    "OFFICIAL TRAFFIC SIGNS" All signs, markings, devices other than signals, not inconsistent with these rules and orders and which conform to the standards as prescribed by the Department of Public Works of the Commonwealth of Massachusetts, and placed or erected by the authority of the public body or official having jurisdiction for the purpose of guiding, directing, warning or regulating traffic.

        (11)    "PARKING" The stopping or standing of vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to an officer or traffic signs or signals, or while making emergency repairs or, if disabled, while arrangements are being made to move such vehicle.

        (12)    "PEDESTRIAN" Any person afoot, or riding upon a conveyance moved by human power, except bicycles or tricycles.

        (13)    "PERSON" An individual, firm, co-partnership, association or corporation.

        (14)    "PARKING METER" Any mechanical device, not inconsistent with these rules and orders, which conform to the standards prescribed by the Department of Public Works of the Commonwealth of Massachusetts, installed for the purpose of enforcing rules and orders relating to the parking of vehicles. Each parking meter shall indicate by proper legend the parking time limited by these rules and orders and when operated shall at all times indicate the balance of parking time not prohibited, and at the expiration of such period shall indicate illegal or overtime parking.

        (15)    "PARKING METER ZONE" Any street or part thereof which parking meters are installed and in operation and upon which the parking of vehicles is limited.

        (16)    "PARKING METER SPACE" Any space within parking meter zones, adjacent to a parking meter, which has been duly designated for the parking of single vehicle by lines painted, or otherwise marked, on the surface of the street.

        (17)    "RAILROAD CROSSING" Any intersection of ways with a railroad right of way.

        (18)    "ROADWAY" That portion of a street or highway between the regularly established curb lines or that part, exclusive of shoulders, approved and intended to be used for vehicular traffic.

        (19)    "ROTARY TRAFFIC" The movement of traffic in a circular manner and where the flow is counter clockwise around an object, structure or island in a roadway.

        (20)    "SAFETY ZONE" Any area or space set aside within a roadway for the exclusive use of pedestrians and which has been indicated by signs, lines or markings, having the written approval of the Department of Public Works of the placePlaceTypeCommonwealth of PlaceNameMassachusetts.

        (21)    "SIDEWALK" That portion of a street or highway set aside for pedestrian travel.

        (22)    "SERVICE ZONE" An area in the roadway set aside for the accommodation of commercial and transient vehicular traffic.

        (23)    "STREET addressStreetOR HIGHWAY" The entire width between property lines of every way open to the use of the public for the purpose of travel.

        (24)    "TAXICAB STAND" An area in the roadway in which certain taxicabs are required to park while waiting to be engaged.

        (25)    "TRAFFIC" Pedestrians, ridden or herded animals, vehicles, and other conveyances, either singly or together while using any street or highway for the purpose of travel.

        (26)    "TRAFFIC CONTROL AREAS" Any area along any way, other than an intersecting way, at which the drivers are to be controlled by traffic control signals.

        (27)    "TRAFFIC CONTROL SIGNAL" Any device using colored lights, which conforms to the standards as prescribed by the Department of Public Works of the Commonwealth of Massachusetts, whether manually, electrically or mechanically operated, by which traffic may be alternately directed to stop and to proceed.

        (28)    "U TURNS" The turning of a vehicle by means of a continuous left turn whereby the direction of such vehicle is reversed.

        (29)    "TRAFFIC ISLAND" Any area or space set aside within a roadway, which is not intended for use by vehicular traffic.

        (30)    "VEHICLE" Every device in, upon or by which any person or property is or may be transported or drawn upon a street or highway except devices moved by human power or used exclusively upon stationary rails or tracks.

        (31)    "COMMERCIAL VEHICLE" Any vehicle being used in the transportation of goods, wares or merchandise for commercial purposes.

        (32)    "COMMERCIAL VEHICLES HEAVY" Any commercial vehicle of two and one half ton capacity or over.

ARTICLE II
AUTHORITY AND DUTIES OF POLICE

SECTION 1. POLICE TO DIRECT TRAFFIC. It shall be the duty of officers designated by the Chief of Police to enforce the provisions of these rules and orders. Such officers are hereby authorized to direct all traffic either in person or by means of visible or audible signal in conformance with provisions of these rules and orders, provided, that in the event of a fire or other emergency, to expedite traffic or safeguard pedestrians, officers of the police or fire department may direct traffic, as conditions may require, notwithstanding the provisions of these rules and orders.

SECTION 2. POLICE MAY CLOSE STREETS TEMPORARILY. The Chief of Police is hereby authorized to close temporarily any street or highway in an impending or existing emergency, or for any lawful assemblage, demonstration or procession provided there is reasonable justification for the closing of such street.

SECTION 3. POLICE MAY PROHIBIT PARKING TEMPORARILY. The Chief of Police is hereby authorized to prohibit temporarily, parking on any street or highway, or part thereof, in an impending or existing emergency, or for a lawful assemblies, demonstration or procession, provided there is reasonable justification for such prohibition. Vehicles parked in places where parking is prohibited temporarily may be moved by or under the direction of an officer.

SECTION 4. EXEMPTIONS. The provisions of these rules and orders shall not apply to drivers actually engaged in work upon the street or highway closed to travel or under construction or repair, to officers when engaged in the performance of public duties nor to drivers of emergency vehicles while operating in an emergency and in performance of public duties when the nature of the work of any of these necessitates a departure from any part of these rules and orders. These exemptions shall not, however, protect the driver of any vehicle from consequences of a reckless disregard of the safety of others.

SECTION 5. OBEDIENCE TO POLICE. No person shall willfully fail or refuse to comply with any lawful order or direction of an officer as defined in placeSnArticle SnI. relating to the direction, control, or regulation of traffic. Any person acting in conformity with any such order or direction shall be relieved from the observance of any provision of these rules and orders, with which it conflicts.

ARTICLE III

SECTION 1. TRAFFIC SIGNS AND SIGNALS. The Superintendent of Public Works is hereby authorized and, as to those signs, signals and parking meters required hereunder, it shall be his duty, to place and maintain or cause to be placed and maintained all official traffic signs, signals, markings, safety zones, parking meters prescribed by the Department of Public Works of the Commonwealth of Massachusetts and parking meter spaces, all of which shall conform to the standards prescribed by the Department of Public Works of the Commonwealth of Massachusetts.

SECTION 2. SIGNS MUST BE ERECTED. Sections 2 and 3 of Article II, Sections 2, 3, 4, 5, 6, 7 and 8 of Article V, relating to parking and Article VII relating to rotary traffic shall be effective only during such time as a sufficient number of official signs are erected and maintained designating the provisions of such sections and located so as to be easily visible to approaching drivers. Section 1 of Article VI relating to one way streets shall be effective only during such time as a sufficient number of official signs are erected and maintained at each of the exits of each one way street, so that at least one sign will be clearly visible for a distance of at least seventy-five (75) feet to drivers approaching the exit.

SECTION 3. DISPLAY OF UNAUTHORIZED SIGNS, SIGNALS AND MARKINGS PROHIBITED. No person or corporation shall place, maintain, or display upon or in view of any street any unofficial device, sign, signal, curb marking or street marking which purports to be or is an imitation of or resembles any official traffic device, sign, signal, curb marking or street marking or which attempts to direct the movement of traffic or which hides from view any official sign, signal or marking device. The Chief of Police is hereby empowered to remove every such prohibited sign, signal, marking or device or cause it to be removed without notice.

SECTION 4. OBEDIENCE TO TRAFFIC SIGNS, SIGNALS AND MARKERS. No driver of any vehicle shall disobey the instructions of any official traffic control signal, sign, marking, marker or legend unless otherwise directed by a police officer.

SECTION 5. INTERFERENCE WITH SIGNS, SIGNALS AND MARKINGS PROHIBITED. Any person who willfully defaces, injures, moves, obstructs or interferes with an official traffic sign, signal or marking, shall be liable to a penalty not exceeding twenty (20) dollars for each and every offense.

SECTION 6. LOCATION OF BUS STOPS, TAXICAB STANDS AND SERVICE ZONES. The location of all bus stops, taxicab stands and service zones shall be specified by the Board of Selectmen and in any case of taxicab stands the Board of Selectmen shall designate who shall use them as such.

SECTION 7. EXPERIMENTAL REGULATIONS. for the purpose of trial, the Board of Selectmen may make temporary rules regulating traffic or test under actual conditions traffic signs, signals, markings or other devices. No such experimental rule relating to traffic shall remain in effect for a period longer than sixty (60) days.

ARTICLE IV
ZONES OF QUIET

SECTION 1. ZONES OF QUIET. All of the territory within two hundred (200) feet of the premises of each hospital in this town is hereby treated and established as a zone of quiet. The Superintendent of Public Works is hereby authorized to erect and maintain in a conspicuous manner within this area such signs and markings as are necessary to designate it as a zone of quiet.

SECTION 2. TEMPORARY ZONES OF QUIET. The Superintendent of Public Works may temporarily establish a zone of quiet upon any street where a person is seriously ill. Said temporary zone of quiet shall embrace all territory within a radius of two hundred (200) feet of the building occupied by the sick person. Said temporary zone of quiet shall be designated by the Superintendent of Public Works by placing at conspicuous place in the street a sign or marker bearing the words "ZONE OF QUIET".

SECTION 3. NOT TO SOUND HORN. No person operating a vehicle within any designated and posted zone of quiet shall sound a horn or other warning device on said vehicle or make any loud or unusual noise in such a zone except in an emergency.


ARTICLE V
STOPPING, STANDING, PARKING

SECTION 1. GENERAL PROHIBITIONS. No person shall allow, permit or suffer any vehicle registered in his name to stop, stand or park in any street, way, highway or road of Saugus in violation of any of the traffic rules and orders adopted by the Board of Selectmen, and in particular in any of the following places except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or traffic sign or signal. Vehicles found violating any of the provisions of this section may be moved by or under the direction of any officer and at the expense of the owner to a place where parking is allowed.
        (a)     Within an intersection except in those areas where the installation of
                parking meters has been specifically approved by the Department of
                Public Works of the PlaceTypeplaceCommonwealth of PlaceNameMassachusetts.
        (b)     Upon any crosswalk.
        (c)     Upon any sidewalk.
        (d)     Upon the roadway in a rural or sparsely settled district.
        (e)     Upon a roadway where parking is permitted unless both wheels on the
                right side of the vehicle are within twelve (12) inches of the curb or
                edge of the roadway except upon those streets which are designated as
                one way streets. On such one way streets vehicles shall be parked in
                the direction in which said vehicle is moving and with both wheels
                within twelve (12) inches of the curb. This shall not apply to streets
                where angle parking is required by these regulations.
        (f)     Upon any roadway where the parking of a vehicle will not leave a clear                  unobstructed lane at least ten (10) feet wide for passing traffic.
       (g)     Upon any street or highway within ten (10) feet of a hydrant.
        (h)     In front of any private road or driveway.
        (i)     Within fifteen (15) feet of the wall of a fire station or directly across
                the street from such station provided signs are erected acquainting the
                driver of such restrictions.
        (j)     Upon any street or highway within twenty (20) feet of an intersecting
                way, except alleys, unless signs have been erected indicating a greater
                distance.

SECTION 3. PROHIBITED PARKING AT SAFETY ZONES. No person shall park a vehicle within twenty (20) feet of either end of a safety zone which is located within thirty (30) feet of the curb or edge of the roadway.

SECTION 4. BUS STOPS.
        (a)     No person shall park a vehicle other than a bus in a bus stop.
        (b)     No person shall park a bus upon any street within a business district at
                any place other than a bus stop, when a nearby bus stop is available for                        use.

SECTION 5. TAXICAB STANDS.
        (a)     No person shall park a vehicle other than a taxicab upon any street
                within a business district in a taxicab stand for a period of time longer
                than fifteen (15) minutes, except while actually engaged in loading or
                unloading, provided that such loading or unloading does not exceed a
                period of time longer than thirty (30) minutes.
        (b)     No person shall park a taxicab upon a street within a business district
                at any place other than a taxicab stand or stands designated for the use
                of his taxicab or taxicabs, except while engaged or while waiting for an                        opportunity to use a taxicab stand designated for his use.

SECTION 6. SERVICE ZONES. No person shall park a vehicle upon a street in any service zone for a period of time longer than thirty (30) minutes and except while actually engaged in loading or unloading.

SECTION 8. ANGLE PARKING.
        (a)     The Board of Selectmen shall determine upon what streets angle
                parking shall be permitted and shall mark or sign such streets, or cause
                same to be marked or signed.
        (b)     Upon the following streets or parts thereof which have been marked or
                signed for angle parking, vehicles shall be parked with one front wheel
                within twelve (12) inches of the curb and at the angle to the curb

SECTION 9. PARKING VEHICLES FOR placeCitySALE PROHIBITED. It shall be unlawful for any person to park upon a street or highway any vehicle displayed for sale.

SECTION 10. REPAIRING OF VEHICLES. No person shall repair, wash or clean vehicles or other conveyances or cause them to be repaired, washed or cleaned in or upon any public way of the town, nor shall any person occupy any part of any public way as storage room for any vehicle, except that emergency temporary repairs may be made.

SECTION 11. ALL NIGHT PARKING PROHIBITED. It shall be unlawful for the driver of any vehicle, other than one acting in an emergency to park said vehicle on any street for a period of time longer than one (1) hour between the hours of 2:00 AM and 6:00 AM of any day.

SECTION 12. EXEMPTIONS. The provisions of this article shall not prevent the stopping of buses at approved bus stop locations nor the parking of taxicabs at designated taxicab stands.

ARTICLE IX

SECTION 1. OVERTAKING OTHER VEHICLES. The driver of a vehicle shall not pass and overtake a vehicle proceeding in the same direction unless there is sufficient clear space ahead on the right side of the roadway to permit the overtaking to be concluded without impelling the safe operation of the vehicle ahead.

SECTION 2. DRIVER TO addressStreetGIVE WAY TO OVERTAKING. The driver of a vehicle when about to be overtaken and passed by another vehicle approaching from the rear shall give way to the right in favor of the overtaking vehicle on suitable and audible signals being given by the driver of the overtaking vehicle and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.

SECTION 3. OBSTRUCTING TRAFFIC.
        (a)     No person shall drive in such a manner as to obstruct unnecessarily the
                normal movement of traffic upon any street or highway. Officers are
                hereby authorized to require any driver who fails to comply with this
                section to drive to the side of the roadway and wait until such traffic as                      has been delayed has passed.
        (b)     No driver shall enter an intersection or a marked crosswalk unless
                there is sufficient space on the other side of the intersection or
                crosswalk and on the right half of the roadway to accommodate the
                vehicle he is operating without obstructing the passage of other
                vehicles or pedestrians notwithstanding any traffic control signal
                indicating to proceed.

SECTION 4. FOLLOWING TOO CLOSELY. The driver of a vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard to the speed of such vehicle and the traffic upon and the condition of the street or highway.

SECTION 5. SLOW VEHICLES TO STAY 200 FEET APART. Upon roadways less than twenty-seven (27) feet wide and upon which vehicular traffic is permitted to move in both directions, the driver of any slow moving vehicle when traveling outside a business or residential district shall not follow another slow moving vehicle within two hundred (200) feet, but this shall not be construed to prevent such slow moving vehicle from overtaking and passing another slow moving vehicle. This section shall not apply to funerals or other lawful processions.

SECTION 6. CARE IN STARTING, STOPPING, TURNING OR BACKING.
        (a)     The driver of any vehicle before starting, turning from a direct line, or
                backing shall first see that such movement can be made in safety. If
                such movement can not be made in safety or it interferes unduly with
                the normal movement of traffic, said driver shall wait for a more
                favorable opportunity to make such movement. If the operation of
                another vehicle should be affected by a stopping or turning movement,
                the driver of such vehicle shall be given a plainly visible signal as
                required by law.
        (b)     BACKING AROUND CORNERS AND INTO INTERSECTIONS. The driver of a vehicle shall not back the vehicle around a corner or into an intersection and shall not in any event or at any place back a vehicle unless such movement can be made in safety.

SECTION 7. OBEDIENCE TO TRAFFIC CONTROL SIGNALS. Colors and arrow indications in traffic control signals shall have the commands ascribed to them in this section, and no other meanings, and every driver of a vehicle, or other conveyance shall comply therewith except when otherwise directed by an officer or by lawful traffic regulating signs (other than a stop sign), signal, or device or except as provided in section 8 of this article.

In no case shall a driver enter or proceed through an intersection without due regard to the safety of other persons within the intersection regardless of what indications may be given by traffic control signals.

        (a)     GREEN
        While the green lens is illuminated, drivers facing the signal may proceed through the intersection, but shall yield the right of way to pedestrians and vehicles lawfully within a crosswalk or intersection at the time such signal was exhibited. Drivers of vehicles making a right turn or left turn shall yield the right of way to pedestrians crossing with the flow of traffic.

        (b)     RIGHT, LEFT AND VERTICAL GREEN ARROWS.
        When a right green arrow is illuminated, drivers facing the said signal may turn right. When a left green arrow is illuminated drivers facing said signal may turn left. When a vertical green arrow is illuminated drivers facing said signal may go straight ahead. When a green arrow is exhibited together with a red or yellow lens, drivers may enter the intersection to make the movement permitted by the arrow but shall yield the right of way to vehicles and pedestrians proceeding from another direction on a green indication.

        (c)     YELLOW
        While the yellow lens is illuminated, waiting drivers shall not proceed and any driver approaching the intersection or marked stop line, shall stop at such point unless so close to the intersection that a stop can not be made in safety, provided however, that if a green arrow is illuminated at the same time, drivers may either enter the intersection to make the movement permitted by such arrow.

        (d)     RED
        While the red lens is illuminated, drivers facing the signal shall stop outside of the intersection, or such point as may clearly marked by a sign or line, provided however, that if a green arrow is illuminated at the same time drivers may either enter the intersection to make the movement permitted by such arrow.

        (e)     RED AND YELLOW
        While the red and yellow lens are illuminated together, drivers shall not enter the intersection and during such time the intersection shall be reserved for the conclusive use of pedestrians.

        (f)     FLASHING RED
        When a red lens is illuminated in a traffic control signal by rapid intermittent flashes, and its use has been specifically authorized by the Department of Public Works, Commonwealth of Massachusetts, drivers shall stop before entering the nearer line or crosswalk of the street intersection, or at the stop line when marked, and the right to proceed shall then be governed by provisions of Chapter 89, Section 8 of the General Laws, Ter. Ed.

        (g)     FLASHING YELLOW
        A flashing yellow lens shall indicate the presence of a hazard and drivers may proceed only with caution.

        (h)     FLASHING GREEN
        A flashing green lens shall indicate an intersection or pedestrian crosswalk in use of subject to use by entering at crossing traffic. Drivers may proceed only with caution and shall be prepared to comply with a change in the signal to a red or yellow or red and yellow indication.

SECTION 8. OBEDIENCE TO ISOLATED STOP SIGNS. Every driver of a vehicle, railway car or other conveyance approaching an intersection of ways where there exists facing him an official sign bearing the word "STOP" or a flashing red signal indication, said signs or signals having apart from these rules and orders, the written approval of the Department of Public Works, Commonwealth of Massachusetts, and such approval being in effect, shall before proceeding through the intersection, bring such vehicle, railway car or other conveyance to a complete stop at such point as may be clearly marked by a sign or line, or if a point is not so marked then at the nearer line or crosswalk of the said intersection. In the case of a line of two or more vehicles approaching such "STOP" sign or flashing red signal indication, the drivers of the second or third vehicle in any group shall not be required to stop more than once before proceeding through the intersection. This section shall not apply when the traffic is otherwise directed by an officer or by a lawful traffic regulating sign, signal or device.

SECTION 9. EMERGING FROM ALLEY OR PRIVATE DRIVEWAY. The driver of a vehicle emerging from an alley, driveway or garage shall stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across alleyway or driveway.

SECTION 10. DRIVING ON ROAD SURFACES UNDER CONSTRUCTION OR REPAIR. No operator shall enter upon the road surface of any street or highway or section thereof, when, by reason of construction, surface treatment, maintenance or the like, such road surface is closed to travel, and one or more signs, lights or signals have been erected to indicate that all or part of the road surface is not to be used, or when so advised by an officer, watchman, member of a street or highway crew, or employee of the town either audibly or by signals.

SECTION 11. NO DRIVING ON SIDEWALKS. The driver of a vehicle shall not drive upon any sidewalk except at a temporary or permanent driveway.

SECTION 12. NO DRIVING THROUGH SAFETY ZONES. It shall be unlawful for the driver of a vehicle, except on signal from a police officer, to drive the same over or through a safety zone.

SECTION 13. NO PASSING A VEHICLE STOPPED FOR A PEDESTRIAN. Whenever any vehicle is stopped to permit a pedestrian to cross the roadway, the driver of another vehicle approaching from the rear shall not overtake and pass such stopped vehicle, notwithstanding the provisions of any other section.

SECTION 14. FUNERALS TO BE PROPERLY IDENTIFIED. A funeral composed entirely of or partly of a procession of vehicles shall be identified as such by means of black pennants bearing a purple cross, or with lighted headlights, or other suitable insignia attached to the first and last vehicle.

        (a)     It shall be the duty of each driver in a funeral or other procession to
                keep as near to the right edge of the roadway as is feasible and to
                follow the vehicle ahead as closely as is practicable and safe.
        (b)     At an intersection where a traffic control signal is operating or a stop
                sign located, the operator of the first vehicle in a funeral or other
                procession shall be the only one governed by the traffic signal or stop
                sign.

SECTION 16. CONSTRUCTION OF AND LOADING OF VEHICLES.  No person shall operate a vehicle in such condition or so constructed or loaded as to be likely to cause delay in traffic or accident or injury to man, beast or property.

SECTION 17. SOUND HORN WHEN NECESSARY. The driver of a vehicle shall give an audible warning with his horn or other suitable warning device whenever necessary to insure safe operation.

SECTION 18. DRIVING ON ROADWAYS LANED FOR TRAFFIC. Where official traffic control devices are erected directing specific traffic to use a designated lane, or designating lanes to be used by traffic moving in a particular direction regardless of the center of the roadway, or to prohibit a turn or to make a required turn at an intersection of roadways, drivers of vehicles shall obey the direction of every such device.

In accordance with the foregoing the following movements are required or prohibited, as the case may be, in the areas described:

ARTICLE X
MISCELLANEOUS PROVISIONS

SECTION 1. COASTING PROHIBITED.
        (a)     Coasting is hereby prohibited on all streets and ways within the Town
                of CityplaceSaugus except as expressly stated elsewhere in this section.
        (b)     On those days when conditions are suitable for coasting, vehicular
                traffic is hereby prohibited from using the following named streets or
                parts of streets during such time as official signs are reserved for
                coasting.
        (c)     The foregoing provision shall not apply to drivers of vehicles having
                business within such reserved areas or to drivers of vehicles whose
                residences are within such reserved areas.

SECTION 2. RESTRICTIONS ON ROLLER SKATES, COASTERS, ETC. No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street at a crosswalk.

SECTION 3. CLINGING TO MOVING VEHICLES. No person riding upon any bicycle, motorcycle, coaster sled, roller skates or any toy vehicle shall attach the same or himself to any moving vehicle upon any road.

ARTICLE XI
MISCELLANEOUS PROVISIONS
ACCIDENT REPORTS - RESPONSIBILITY

SECTION 1. DRIVERS MUST REPORT ACCIDENTS.
        (a)     The driver of any vehicle involved in an accident resulting in the injury or death of any person, or property damage to the apparent total extent of two hundred (200) dollars or more to any one vehicle or other property shall within five (5) days make a full and complete report in writing of such accident to the Police Department. Any driver who has been incapacitated as a result of such accident, and to such an extent as make reporting impossible or unfavorable to his recovery, shall not be required to report such accident until he has recovered sufficiently to do so. The report shall be made on a form furnished by the police department, copies of which shall be made available at the police station. Compliance with this section, however, shall not relieve such drivers from additional responsibility of reporting to the Registry of Motor Vehicles any accident in which any person is killed or injured.

        (b)     The Police Department of the Town may require any driver of a vehicle involved in an accident, of which report must be made as provided in this section, to file supplemental reports whenever the original report is insufficient in the opinion of said department.

SECTION 2. OWNERS PRIMA FACIE RESPONSIBLE FOR VIOLATIONS. If any vehicle is found upon any street or highway in violation of any provisions of these rules and orders, and then identity of the driver can not be determined, the owner or the person in whose name such vehicle is registered shall be held prima facie responsible for such violation.

SECTION 3. EXEMPTIONS. The provisions of these rules and orders shall not apply to drivers actually engaged in work upon a street or highway closed to travel or under construction or repair, to officers when engaged in the performance of their public duties, nor to drivers of emergency vehicles while operating in an emergency and in performance of public duties, when the nature of the work of any of these necessitates departure from any part of these rules and orders.

These exemptions shall not, however, protect the driver of any vehicle from the consequences of a reckless disregard of the safety of others.

ARTICLE XII
PENALTIES - REPEAL - EFFECT OF REGULATIONS
PENALTIES

Any person violating any provision of any rule, regulation or order regulating the parking of motor vehicles within the Town of Saugus, made by any body authorized to make the same shall be dealt with as provided in section 20A of Chapter 90 of the General Laws as amended and any person violating any of the rules and regulations applicable to state highways made by the Department of Public Works of the Commonwealth of Massachusetts under authority of section 2 of Chapter 85 of the General Laws shall be subject to the penalty provided in said rules and regulations.

Any person convicted of a violation or any rule, regulation or order made hereunder except as otherwise provided shall be punished by a fine not exceeding twenty (20) dollars for each offense.

ARTICLE XIII
PEDESTRIAN CONTROL REGULATIONS

SECTION 1. PEDESTRIANS CROSSING WAYS OR ROADWAYS. Pedestrians shall obey the direction of police officers directing traffic and whenever there is an officer directing traffic, a traffic control signal or a marked crosswalk within three hundred (300) feet of a pedestrian, no such pedestrian shall cross a way or roadway except within the limits of a marked crosswalk and as hereinafter provided in these regulations. For the purpose of these regulations, a marked crosswalk shall only be constructed to be that area of a roadway reserved for pedestrian crossing located between two solid white reflector twelve (12) inch pavement markings in rural areas or markings not less than six (6) inches wide in urban areas, said markings or lines being no less than six (6) feet apart.

SECTION 2. PEDESTRIAN ACTUATION.
        (a)     At a traffic control signal located where pedestrians indications are provided but which are shown only upon actuation by means of a pedestrian push button, no pedestrian shall cross a roadway unless or until the pedestrian control signal push button has been actuated and then cross only on the proper pedestrian signal indication. At traffic control signal located where no pedestrian indication is provided, pedestrians shall cross only on the green indication. If necessary, the green indication shall be actuated by the pedestrian by means of a push button.
        (b)     At a traffic control signal location, pedestrians shall yield the right of way to vehicles of a funeral or other procession or authorized emergency vehicle while in performance of emergency duties regardless of the signal indication given, and they shall not attempt to cross the roadway until such vehicles or procession has passed at which time pedestrians shall then cross the roadway only as provided in these regulations.

SECTION 3. PEDESTRIAN OBEDIENCE TO TRAFFIC CONTROL SIGNALS. Traffic control signal color indications and legends shall have the commands ascribed to them in this section and no other meaning, and every pedestrian shall comply therewith, except when otherwise directed by an officer.
        (a)     RED AND YELLOW or the word "WALK" - Whenever the red and yellow lenses are illuminated together or the single word "walk" is illuminated, pedestrians facing such indication may proceed across the roadway and in the direction of such signal only.
        (b)     RED ALONE or DON'T WALK - Whenever the words "Don't Walk" or any indication other than red and yellow shown together are illuminated in a traffic control signal where pedestrian indications are provided, pedestrians approaching or facing such indication shall wait on the sidewalk, edge of roadway or in the pedestrian refuge area of a traffic island and shall not enter upon or cross a roadway until the proper indication is illuminated in the traffic control signal, but any pedestrian who has partially completed his crossing on the walk indication shall proceed or return to the nearest sidewalk or safety island on the yellow indication, the red indication or when the words "Don't Walk" are illuminated by rapid intermittent flashes.
        (c)     GREEN ALONE - At traffic control signal locations where no pedestrian indication is given or provided, pedestrians facing the signal may proceed across the roadway within any marked crosswalk in the direction of the green indication.
        (d)     YELLOW ALONE, RED ALONE or FLASHING "DON'T WALK" - Pedestrians approaching or facing a yellow, red or flashing "Don't Walk" illuminated indication shall not start to cross a roadway.
        (e)     FLASHING RED, YELLOW or GREEN - At any traffic signal location where a flashing green indication is being given facing a crosswalk, pedestrians shall actuate, where provided, the pedestrian signal indication and cross the roadway only on the red - yellow or "Walk" indication where such indication is in operation. If no pedestrian signal is provided, pedestrians shall cross within crosswalks with due care.

SECTION 4. PEDESTRIAN CROSSING AND USE OF ROADWAYS.
        (a)     No pedestrian shall suddenly leave a sidewalk or safety island and
                walk or run into the path of a vehicle which is so close that it is
                impossible for the driver to yield the right of way.
        (b)     Pedestrians shall at all times attempt to cross a roadway using the right
                half of crosswalks.
        (c)     Where sidewalks are provided, it shall be unlawful for any pedestrian
                to walk along and upon an adjacent roadway whenever the sidewalk is
                open to pedestrian use.
        (d)     Where sidewalks are not provided, any pedestrian walking along and
                upon a highway shall, when practicable, walk only on the left side of
                the roadway on its unfinished shoulder facing traffic which may
                approach from the opposite direction.
        (e)     Persons alighting from the roadway side of any vehicle parked at the
                curb or edge of roadway shall proceed immediately to the sidewalk or
                edge of roadway adjacent to vehicle, and shall cross the roadway only
                as authorized by these regulations.
        (f)     It shall be unlawful for any person to actuate a pedestrian control
                signal  or to enter a marked crosswalk unless a crossing of the roadway
                is intended.

SECTION 5. CROSSING AT NON-SIGNALIZED LOCATIONS. Every pedestrian crossing a roadway at any point other than within a marked crosswalk shall yield the right of way to all vehicles upon the roadway. At a point where a pedestrian tunnel or overpass has been provided pedestrians shall cross the roadway only by the proper use of the tunnel or overpass.

SECTION 6. OPERATORS TO EXERCISE DUE CARE. The provisions of these regulations shall in no way abrogate the provisions of Chapter 90, section 14 and 14A of the General Laws. (Ter. Ed.) which provide: "Precautions for safety of other Travelers" and for the "Protection of Blind Persons Crossing Ways". Furthermore, notwithstanding the provisions of these regulations every operator of a vehicle shall exercise due care to avoid colliding with any pedestrian upon the roadway and shall give warning by sounding the horn when necessary and shall exercise proper precautions which may become necessary for safe operation.

SECTION 7. PEDESTRIANS SOLICITING RIDES OR BUSINESS. No person shall stand in a roadway for the purpose of soliciting a ride, employment or business from the operator or occupant of any vehicle without the written permission of the Board or officer having control of such roadway or highway.

SECTION 8. OFFICERS TO ENFORCE PEDESTRIAN REGULATIONS. These pedestrian control regulations shall be enforced by all officers of the Town of placeCitySaugus on and after September 1, 1974.

SECTION 9. EXEMPTIONS. The provisions of these rules and regulations governing the use of ways by pedestrians shall not apply to pedestrians actually engaged in work upon a roadway closed to travel or under construction or repair, to municipal, state, federal or public service corporation employees while in the performance of their public duties or to pedestrians acting in an emergency when such emergency necessitates departure from any part of these rules and regulations.

SECTION 10. PENALTIES. Any person who violates the provisions of this article which deals with the proper use of ways by pedestrians shall be punished as provided in Chapter 90, section 18A of the General Laws (Ter. Ed.) Any person convicted of a violation of any other provisions of these regulations relative to the operation of vehicles shall be punished by a fine not exceeding twenty (20) dollars for each offense.

SECTION 11. EFFECT OF REGULATIONS. All existing rules and regulations governing the operation of vehicles or the use of ways by pedestrians which are inconsistent herewith are hereby expressly repealed. This repeal shall not, however, affect any punishment or penalty imposed or any complaint of prosecution pending at the time of passage hereby for any offense committed under any of the said rules and regulations hereby repealed.

If any section, sub-section, sentence, clause or phrase of these rules and regulations is for any reason unconstitutional, such decision shall not affect the validity of the remaining portion of these rules and regulations. The Board of Selectmen of the Town of Saugus hereby declare that they would have passed these rules and regulations and each section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub-sections, clauses or phrases be declared unconstitutional.

Under the provisions of Chapter 90, Section 20 C Massachusetts General Laws the following regulations have been adopted by the Board of Selectmen. This covers the penalties to be assessed for violation of the regulations concerning parking, etc. as outlined in the Traffic Rules and Orders of the Town of placeCitySaugus and Article XXV of the By-Laws of the Town.

A.      Any person, whether he be the owner or operator of any vehicle involved in
        any of the following listed violations of the Traffic Rules and Orders of the
        Town of Saugus, or in violation of Article XXV of the By-Laws of the Town,      and for being found guilty by a court having jurisdiction, shall forfeit a sum of       not less than $5.00 for each or any of the following offenses:

                a.      Restricted street area
                b.      overtime parking
                c.      parking between 2:00 am and 6:00 am
                d.      right wheels over twelve inches (12") from curb
                e.      within ten feet (10') of a hydrant
                f.      within twenty feet (20') of an intersection
                g.      within twenty feet (20') of a safety zone
                h.      parking at a bus stop
                i.      parking at a taxi stand
                j.      obstructing driveway
                k.      parking on a sidewalk
                l.      parking in fire lanes
                m.      parking so as to obstruct fire lanes

SECTION 12A: SCHEDULE OF PENALTIES FOR PARKING VIOLATIONS. As follows:
All parking penalties to be $25. except for #13 – within 10’ of a hydrant $100;
                                        #16 – fire / breakdown lane $50;
                                        #17 – Impeding street cleaning or snow removal $100;
                                        #19 – snow emergency $100;
                                        #20 – crosswalk $50;
                                        #21 – sidewalk $50;
                                        #22 – handicap ramp $300;
                                        #23 – HP / DV parking $300;
and By-Law violations to be in accordance with the penalties under the By-Laws $50 to $300.

TOWING OF MOTOR VEHICLES
                                                                                             

In accordance with the provisions of Chapter 40, Section 22D, Massachusetts General Laws, the Board of Selectmen do herewith adopt the following Rules and Regulations authorizing the removal to a convenient place of vehicles parked or standing in such a manner, or in such areas as are hereinafter described. Vehicles specifically exempt by law shall not however be subject to such removal.

        1.      The moving or towing of any vehicle shall be under the provisions of
                these Rules and Regulations and shall be at the direction of the Chief
                of Police or such officers of the rank of sergeant or higher as he may
                from time to time designate.

               2.      No person shall stand or park or allow, permit or suffer any vehicle
                registered in his name to stand or park in any of the following places or                       areas:
                   
                a.      Upon any way in such a manner as to impede the plowing or
                        removal of snow or ice.
                b.      In an area designated as a "addressStreetFire Lane".
               c.      In a manner which impedes passage or presence of Fire Fighting
                        equipment.
                d.      Upon any sidewalk.
                e.      Upon any crosswalk.
                f.      Upon any way within twenty feet (20') of an intersecting way.
                g.      Upon a way within ten feet (10') of a hydrant.
                h.      In front of a public or private driveway.
                i.      Upon any way where the parking of a vehicle will not leave a
                        clear an unobstructed lane of at least ten feet (10') wide for
                        passing traffic.
   
AUTOMATED RED LIGHT AND SPEED ENFORCEMENT REGULATIONS

SECTION 1. DEFINITIONS. In this section, the definitions of the following shall mean:
1.)     “Board of Selectmen” means acting as Saugus Traffic Commissioners.
2.)     Department” means the Police Department of the Town of Saugus, Massachusetts.
3.)     “Owner” means the owner of a motor vehicle as shown on the motor vehicle registration records of the Massachusetts Registry of Motor Vehicles or the analogous department or agency of another state or country. The term “owner” includes (i) a lessee of a motor vehicle under a lease of 6 months or more or (ii) the lessee of a motor vehicle rented or leased from a motor vehicle rental or leasing company, but does not include the motor vehicle rental or leasing company itself.
4.)     “Photographic Traffic Monitoring System” means a system that:
             a.) Consists of a combination of multiple digital cameras with a single synchronized time source and a full motion video and vehicle sensor installed to work in conjunction with an electrically operated traffic control signal.
             b.) Is capable of producing at least three discreet recorded images that depict the Registration Plate Number attached to the rear of a motor vehicle that is not operated in compliance with the traffic control signal.
5.)     “Recorded Images” means a digital image, automatically recorded by a photographic traffic monitoring system that depicts the rear of a motor vehicle.
6.)     “System Location” means the approach to an intersection toward which a photographic traffic monitoring system is directed and in operation.
7.)     “Traffic Control Signal” means a traffic control device that displays alternating red, amber and green lights that direct traffic when to stop at or proceed through an intersection.
8.)     “Speed Traffic Monitoring System” means a system that:
             a.) Consists of a combination of multiple digital cameras with a single synchronized time source to work in conjunction with an electrically operated speed detection device.
              b.) Is capable of producing multiple discreet recorded images that depict the registration plate attached to the rear of the motor vehicle.
              c.) A system that is certified by the International Chiefs of Police Association (IACP).
SECTION 2. IMPOSITION OF CIVIL PENALTY

A.)     The Town of Saugus Traffic Commissioners find and have determined that a vehicle that proceeds into an intersection when the traffic control signal for that vehicle’s direction of travel is emitting a steady red signal damages the public by endangering vehicle operators and pedestrians alike, decreasing the efficiency of traffic control and traffic flow efforts, and increasing the number of serious accidents to which safety agencies must respond at the expense of the town taxpayers.

B.)     The owner of a motor vehicle is liable for a civil penalty if the vehicle proceeds into an intersection at a system location when the traffic control signal for that vehicle’s direction of travel is emitting a steady red signal.

C.)     The civil penalty for Section 2 (B) shall be set by the Board of Selectmen. However, the civil penalty cannot exceed the amount set forth by Mass. General Law Chapter 89: Section 9 (Designation of highways as throughways; traffic control signs and devices).

D.)     The Town of Saugus Traffic Commissioners find and determine that a vehicle that travels at speeds greater than are allowed under the law damages the public by endangering vehicle operators and pedestrians alike, decreasing the ability of motorists and pedestrians to react in time in cases of emergency and / or accident avoidance efforts, and increasing the number of serious accidents to which public safety agencies must respond at the expense of the town taxpayers.

E.)     The owner of a motor vehicle is liable for a civil penalty if the vehicle is operated at a speed greater than are allowed under the law.

F.)     The civil penalty for Section 2 (E) shall be set by the Board of Selectmen. However, the civil penalty cannot exceed the amount set forth by Mass. General Law Chapter 90; Section 17 (Speed limits).

G.)     A police administration fee equal to the annual Departmental cost and operation of this traffic safety program shall be set aside in a Traffic Enforcement and Education Revolving Fund as outlined in the Mass. General Laws Chapter 44, Section53E.

SECTION 3. ENFORCEMENT PROCEDURES

A.)     The Saugus Police Department is responsible for the enforcement and administration of this article.

B.)     In order to impose a civil penalty under this article, the Saugus Police Department shall cause to be mailed a notice of violation to the owner of the motor vehicle liable for the civil penalty not later than 30th day after the date the violation is alleged to have occurred to:
            1.) The owner’s address as shown on the registration record of the Mass. Registry of Motor Vehicles.
             2.) If the vehicle is registered in another state or country, the owner’s address as shown on the motor vehicle registration record of the department or agency of the other state or country analogous to the Mass. Registry of Motor Vehicles.

C.)     A notice of violation issued under this article shall contain the following:
             1.) A description of the violation alleged.
             2.) The location of the intersection or street where the violation occurred.
             3.) The date and time of the violation.
             4.) The name and address of the owner of the vehicle involved in the violation.
             5.) The registration number displayed on the registration plate of the vehicle involved in the violation.
             6.) A copy of a recorded image of the vehicle involved in the violation that depicts the registration number displayed on the registration plate of the vehicle.
             7.) The amount of the civil penalty to be imposed for the violation.
             8.) The date by which the civil penalty must be paid.
             9.) A statement that a recorded image is evidence in a proceeding for the imposition of a civil penalty.
           10.) Information that informs the person named in the notice of violation:
        a.) Of the person’s right to contest the imposition of the civil penalty against the person in an administrative adjudication.
        b.) Of the manner and time in which imposition of the civil penalty may be contested.
        c.) That failure to pay the civil penalty or to contest liability in a timely manner is an admission of responsibility and that failure to appear at an administrative adjudication hearing after having requested a hearing is an admission of liability.
        d.) That failure to pay the civil penalty within the time allowed shall result in the imposition of a late payment fee of $50.
          11.) A statement that, if at the time and place of the violation the vehicle was being operated by a person other than the owner, if the owner is a natural person, the owner may transfer liability for the violation to the person who was operating the vehicle at that time and place if the owner submits to the Town of Saugus by affidavit, on a form provided by the Town, or under oath at an administrative adjudication hearing the name and current address of the person.
        a.) Operating the vehicle at the time and place of the violation.
        b.) Who was the lessee of the vehicle at the time of the violation, if the vehicle was rented or leased from a person in the business of renting or leasing motor vehicles at that time.
        c.) Who was the subsequent owner of the motor vehicle, if the owner transferred ownership of the vehicle before the time of the violation.

D.)     A notice of violation under this article is presumed to have been received on the fifth day after the date the notice of violation is mailed.

E.)     In lieu of issuing a notice of violation, the Police Department may mail a warning notice to the owner that, in addition to any other information contained in the warning notice, must contain the information required by subsection C.

SECTION 4. ADMINISTRATIVE ADJUDICATION HEARINGS

A.)     A person who receives a notice of violation under this article may contest the imposition of the civil penalty by requesting in writing and administrative adjudication of the civil penalty within the time provided in the notice (which period shall not be more than 21 days following the mailing of the notice). Upon receipt of the request, the Police Department shall notify the person of the date and time of the administrative adjudication hearing.

B.)     Failure to pay a civil penalty or to contest responsibility in a timely manner is an admission of liability in the full amount of the civil penalty assessed in the notice of violation and constitutes a waiver of the right to appeal under Section 4 (K).

C.)     Failure to appear at an administrative adjudication hearing after having requested a hearing is an admission of responsibility for the full amount of the civil penalty assessed in the notice of violation and constitutes a waiver of the right to appeal under Section 4 (K).

D.)     A person who fails to pay a civil penalty within the time allowed by this article shall be additionally liable for a late payment penalty in the amount of fifty dollars.

E.)     The civil penalty shall not be assessed if:
              1.) After a hearing, the hearing officer enters a finding of no liability.
              2.) Within the time prescribed in the notice of violation, the person against whom the civil penalty is to be assessed submits the proof described in Section 3 (C.), article 11.

F.)     A person who requests an administrative adjudication hearing and thereafter fails to appear at the time and place of the hearing is liable for administrative hearing costs in the amount of fifty dollars in addition to the amount of the civil penalty assessed for the violation. A person who is found liable for a civil penalty shall pay the civil penalty and costs within 10 days of the hearing.

G.)     In an administrative adjudication hearing, the issues must be proved at the hearing by a preponderance of the evidence. The reliability of the photographic traffic control signal monitoring system used to produce the recorded image of the violation may be attested to in an administrative adjudication hearing by affidavit of an officer or employee of the Town of Saugus or the entity with which the Town contracts to install or operate the system and who is responsible for inspecting and maintaining the system.

H.)     It shall be an affirmative defense to liability under this article, to be proven by a preponderance of the evidence that:
             1.) The traffic control signal was not in proper position and sufficiently legible to an ordinary observant person.
             2.) The operator of the motor vehicle was acting in compliance with the lawful orders or direction of a police officer.
             3.) The operator of the motor vehicle violated the traffic control signal so as to yield the right of way to an immediately approaching authorized emergency vehicle.
             4.) The motor vehicle was being operated as an authorized emergency vehicle under Chapter 89, Section 7B “Operation of Emergency Vehicles”: of the Mass. General Laws and that the operator was acting in compliance with that chapter.
             5.) The motor vehicle was a stolen vehicle and being operated by a person other than the owner of the vehicle without the effective consent of the owner.
             6.) The registration plate depicted in the recorded image of the violation was a stolen registration plate and being displayed on a motor vehicle other than the motor vehicle for which the plate had been issued.
             7.) If the owner of the vehicle is a natural person and a person other than the owner of the vehicle was operating the vehicle and within the time prescribed in the notice of violation, the person against whom the civil penalty is to be assessed submits the proof described in section 3(C), article 11.
             8.) The presence of ice, snow, unusual amounts of rain or other unusually hazardous road conditions existed that would make compliance with this article more dangerous under the circumstances than non-compliance.
              9.) An affirmative defense to responsibility would be if proven that the traffic control device was not operating properly at the time of the alleged violation.

I.)     To demonstrate that at the time of the violation the motor vehicle was a stolen vehicle or the registration plate displayed on the motor vehicle was a stolen plate, the owner must submit proof acceptable to the hearing officer that a theft of the vehicle or registration plate had been timely reported to the appropriate law enforcement agency.

J.)     Notwithstanding anything in this article to the contrary, a person who fails to pay the amount of a civil penalty or to contest liability in a timely manner is entitled to an administrative adjudication hearing on the violation if:
             1.) The person files an affidavit with the hearing officer stating the date on which the person received the notice of violation that was mailed to the person.
             2.) Within the same period by Section 3 (C ), article 10 (b) for a hearing to be timely requested but measured from the date the mailed notice was received as stated in the affidavit filed under subdivision 1, the person requests an administrative adjudication hearing.

K.)     A person who is found liable after an administrative adjudication hearing may appeal that finding of liability to the District Court by filing a notice of appeal with the clerk of the District Court. The notice of appeal must be filed no later than the 31st day after the date on which the administrative adjudication hearing officer entered the finding of liability and shall be accompanied by the payment of an appellate filing fee as determined by the court. Unless the person, on or before the filing of the notice of appeal, posts a bond in the amount of the civil penalty and any late fees, an appeal does not stay the enforcement of the civil penalty. The District Court shall determine an appeal by trial de novo. The District Court Judge in the trial de novo shall admit the affidavits submitted under Section 4 (G) and the issues must be proven by a preponderance of the evidence. The Town of placeCitySaugus shall submit to the District Court Judge an affidavit attesting to the reliability of the photographic traffic control signal monitoring system used to produce the recorded images of the violation. An officer or employee of the Town of CitySaugus or the entity with which the Town of CityplaceSaugus contracts to install or operate the system and who is responsible for inspecting and maintaining the system shall make the affidavit.

L.)     The Board of Selectmen will appoint / hire the administrative adjudication hearing officer. The appointment will be on a yearly basis expiring the end of August.   

SECTION 5. EFFECT OF LIABILITY: EXCLUSION OF CIVIL REMEDY; ENFORCEMENT

A.)     The imposition of a civil penalty under this article is not a conviction and may not be considered a conviction for any purpose.

B.)     The Police Department may not impose a civil penalty under this article on the owner of a motor vehicle if the operator of the vehicle was arrested or was issued a citation and notice to appear by a police officer for a violation of Chapter 89, Section 9 of the Mass. General Laws which is also recorded by the traffic control signal monitoring system for the same event.

C.)     The Police Department is authorized to file suit to enforce collection of civil penalty assessed under this article.

D.)     All fines issued under these sections may be recovered by a non-criminal disposition procedure promulgated in Mass. General Law Chapter 40, Section 21D, which procedures are incorporated herein by reference; provided however, that if a person in violation fails to follow the procedures and requirements of Mass. General Law Chapter 40, Section 21D then the fines shall be recovered by indictment or by complaint pursuant to Mass. General Law Chapter 40, Section 41.

SECTION 6. LOCATION OF PHOTOGRAPHIC TRAFFIC MONITORING SYSTEM

A.)     The placement and / or removal of any / all photographic traffic monitoring system must be approved by the Board of Selectmen at a public hearing.

B.)     All roadways leading to a traffic monitoring system must have a sign warning motorists of the system.

APPROVED LOCATIONS are as follows:
        At traffic light on Salem Turnpike at addressStreetaddressStreetBallard St. – north & south;
        At traffic light on addressStreetWalnut St. at placeCentral St. – east & west.
Mobile Unit assignment: to be assigned to various locations throughout Town as deemed necessary by the Chief of Police or designee.

SECTION 7. SEVERABILITY

        If any person or subsection of this section shall be held to be invalid by a court of competent jurisdiction, then such person or subsection shall be considered separately and apart from the remaining provisions or subsections of this section, which shall remain in full force and effect.
