TOWN OF SAUGUS, MASSACHUSETTS, TOWN MANAGER

DECLARATION OF EMERGENCY

WHEREAS, a sudden, generally unexpected occurrence of circumstances demanding public action has arisen within the world, country, state and Town of Saugus due to the coronavirus pandemic and other illnesses; and

WHEREAS, on March 13, 2020 the President of the United States has declared a national emergency due to this situation and has directed the agencies of the national government to take appropriate actions; and

WHEREAS, on March 10, 2020 the Governor of the Commonwealth of Massachusetts declared that there now exists a state of emergency and has directed the agencies of the state government to take appropriate actions; and

WHEREAS, on March 15, 2020, Governor Baker announced emergency actions to respond to the evolving COVID-19 public health emergency impacting the Commonwealth, including prohibitions on public gatherings of twenty-five or more people and prohibiting on-premises consumption of food or drink at bars and restaurants from March 17, 2020 until April 6, 2020, as well as suspension of elementary and secondary school educational operations from March 17, 2020 until April 6, 2020; and

WHEREAS, on March 23, 2020, Governor Baker issued COVID-19 Order No. 13, which designated certain COVID-19 Essential Services, as defined in the Order, temporarily closed the bricks-and-mortar premises of businesses and organizations that do not provide COVID-19 Essential Services, and prohibited gatherings of more than 10 people; through April 7, 2020; and

WHEREAS, on March 31, 2020, Governor Baker issued COVID-19 Order No. 21, which amended the earlier list of COVID-19 Essential Services and extended the operation of COVID-19 Order No. 13 through May 4, 2020; and

WHEREAS, on April 28, 2020, Governor Baker issued COVID-19 Order No. 30, which extended the provisions of Order No. 13, as amended by Order No. 21, until May 18, 2020; and

WHEREAS, The Town Manager of the Town of Saugus, Massachusetts, upon advice and consolation of his advisors has determined that the situation poses a present, reasonable and imminent danger to public health, safety, or general welfare of the people of Saugus or their property so that it has become necessary for the Town Manager, with such assistance and staff as he deems necessary, to utilize and coordinate the services, equipment, supplies, and facilities of existing departments, offices, and agencies or the community, both locally, regionally, statewide and nationally, if necessary, including the taking or ordinary and extraordinary actions for the purposes of emergency management and emergency functions to protect the public; and

WHEREAS, a Declaration of Emergency and immediate action is needed to prevent, minimize, or mitigate damage to public health, safety, or general welfare of the people of Saugus and the Commonwealth and/or property which may otherwise result from the above described situation; and

WHEREAS, the people of the community of Saugus should be able to depend upon guidance from their Chief Municipal Officials;

NOW THEREFORE, the Town Manager of the Town of Saugus, Massachusetts, hereby declares that as of May 1, 2020 a State of Emergency is declared to exist by the Town Manager and authorizes and directs all Town personnel and agents to take action appropriate to respond to this situation and ratifies, confirms and adopts any related action taken prior to the formal adoption of this Declaration. This Declaration of Emergency shall remain in effect until notice is given, pursuant to the judgment of the Town Manager, that the State of Emergency no longer exists.
